Being a spouse doesn't give you medical decision-making authority: a document does
This item costs very little and takes almost no time, but skipping it exacts its price at the exact moment you can least absorb it.
A premise many people have backwards
"I'm their spouse, so obviously I can make medical decisions for them and see their records."
That doesn't hold up legally.
Spousal status by itself does not automatically give you medical decision-making authority, nor access to medical records. A hospital looks at documents, not relationships.
In an emergency, if you can't produce those documents, the hospital may not let you make decisions. They aren't trying to be difficult, they're just following the rules.
Three documents
- Healthcare Proxy / Medical Power of AttorneyThis one is used to name who can make medical decisions for you when you can't express your wishes.
- Durable Power of AttorneyThis grants financial authority, allowing the other person to help handle bills, insurance, and property if you become incapacitated.
- HIPAA authorizationThis allows medical providers to share your health information with the people you name.
The third one is most often missed. The first two grant the "right to decide," while the HIPAA authorization grants the "right to know." Without it, the hospital may not even be able to share your condition with you.
Why it matters especially after marriage
Once you're married, your lives are tied together: a shared house, shared bills, possibly children. If one of you is suddenly incapacitated, the other isn't only an emotional caregiver. They have a pile of practical things to handle.
By that time, you won't have time to petition a court for guardianship, because that process takes months and is genuinely painful.
More important still for cross-border couples
If yours is a cross-border marriage, or one spouse's family is in Taiwan, these documents matter one level more:
- Family in Taiwan can't get there in time, so you're the only person present
- Where there's a language barrier, the hospital needs written authorization even more
- If your marriage might not be immediately recognized in certain settings (see item 74 of the checklist), the document is the most direct proof there is
How to do it
These documents are usually handled together with a will (see item 57 of the checklist), and an estate planning attorney will prepare them as a set. In simple situations, an online service works, or you can ask the hospital directly, as many have ready-made healthcare proxy forms you can fill out.
Forms and witnessing requirements differ by state; some need a notary, some need two witnesses. Check your state's rules before filling anything in.
Once they're done
