Changing your name after marriage: SSA, then DMV, then passport — get the order wrong and you waste the trip

What decides whether changing your name after marriage is free and automatic or a court proceeding is a very short moment: the ten minutes the two of you spend filling in the marriage license application at the county clerk's counter.

The box on that form

The marriage license application has a box asking what name you intend to use after marriage.

Fill it in there, and the certified copy of your marriage certificate carries you the rest of the way. Nobody along that path asks you to justify the change — the certificate itself is the legal basis.

Leave it blank and decide later, and in most states the answer is: petition a court for a name-change order. A filing, a fee, in some states a published notice, and a wait measured in months.

So if there is any chance at all that you might want to change it, fill in the box at the counter. Filling it in doesn't oblige you to use it. Leaving it blank cannot be undone.

Three places: SSA first, DMV after

Once you have decided, three offices need updating: the Social Security Administration (SSA), the DMV, and your passport.

Why SSA comes before the DMV

Because the DMV cross-checks SSA's records. The California DMV says outright to notify the SSA first, and a mismatch gets rejected (California example: CA DMV page on updating your driver's license or ID card).

Going to the DMV first doesn't get you finished sooner. It just wastes the trip.

First stop: Social Security

What to bring:

Your Social Security number does not change. What changes is the name recorded against it.

The SSA recommends waiting at least 30 days after the wedding before applying, so the state can update its records (SSA notice (2024-08-08)). The new card arrives in about 5–10 business days (SSA: replacing or updating your card).

Second stop: the DMV, once SSA is done

This step is not technically difficult, but the timing will cost you the trip.

The California DMV says outright to notify the SSA first. If SSA still has your old name, the DMV's cross-check won't match and you'll be rejected.

Third stop: passport

A passport name change needs a certified marriage certificate (Form DS-82 (U.S. Department of State)). For what to bring and which form to use, go by the State Department's rules.

And then a long tail you may not have thought about

Three government offices only fixes your legal identity. There is a longer list in ordinary life, and missing one usually doesn't bite immediately — it bites at the worst moment:

The two to do first are banking and taxes. A name that doesn't match your tax records will hold up a refund, and a ticket that doesn't match your ID will stop you at the gate.

If you decide not to change it

Not changing your name is perfectly fine and very common in the United States. You can skip this whole thing.

The only thing to note: if a spousal green card is in your future, keeping one consistent name across every document is the path of least work. Changing your name does not harm the case, but changing it halfway — new name on some documents, old name on others — creates explaining to do.

So the order is

  1. Decide your married name at the counter, on the license application
  2. Order certified copies of the certificate, and order extras
  3. SSA: Form SS-5, with a certified copy (the SSA recommends waiting at least 30 days after the wedding)
  4. DMV: new license
  5. Passport: include a certified marriage certificate
  6. Then banks, insurance, taxes, leases, and the rest
